ITIN for foreign property owners: when a lot owner needs one

The ITIN comes up in every conversation about buying in the US. You do not need one to buy a lot, but you will at two specific moments. Here is when, how to apply and what you pay each year.

What is an ITIN?

It is a 9-digit number the IRS, the US tax agency, issues to people who need a tax identification number but cannot get a Social Security number (SSN).

As the IRS explains, it is for federal tax purposes only. It does not give you immigration status, authorize you to work in the US or qualify you for Social Security benefits. Think of it as your tax ID with the US tax authority.

Do I need an ITIN to buy land in the US?

Not to buy one of our lots. You sign the promise of sale with your ID card or passport, and the deed is recorded in the county in your name without an ITIN.

When do I need an ITIN?

When you have to file a US tax return. With a lot, that happens in two cases: if you rent it out and want to be taxed on net income, or when you sell it.

The table sums up each situation. As long as you only own the lot, without renting or selling it, you have no income tax return to file for it.

If you rent out US property, a nonresident's rental income is taxed at 30% of the gross amount unless you elect to be taxed on net income. That election means filing Form 1040-NR every year, and for that you need an ITIN.

What happens with taxes if I sell the lot one day?

When a foreigner sells US property, the buyer generally has to withhold 15% of the price and pay it to the IRS. That withholding is not the final tax: you then file a return and recover what is due.

This is the FIRPTA rule. The USD 300,000 exception you will see elsewhere only applies when the buyer will live in the property, so do not count on it. A reduced withholding can be requested with Form 8288-B.

For the IRS to credit what was withheld, you must file a US tax return with your identification number. If you have no ITIN, you can apply then by attaching Form W-7. We do not promise the lot will rise in value; if you sell, this is what to know beforehand.

How to apply for an ITIN from Chile, Argentina or Brazil

With Form W-7, usually sent together with the tax return that requires it. You can apply by mail, through a certifying acceptance agent (some are outside the US) or at an IRS office.

Form W-7 asks for documents proving your identity and foreign status, usually your passport. According to the IRS, a response takes about 7 weeks, or 9 to 11 if you apply from abroad or during tax season. Applying at an IRS office is free; acceptance agents charge their own fee.

Because the ITIN is requested when there is a return to file, the usual path is to get it with a US accountant when you rent or sell, not when you buy.

What a lot costs to own each year

Property tax on a lot like ours is low: about USD 20 a year (to be confirmed with a recent Fulton County bill). While you pay the instalments, the seller pays that tax until the lot is deeded to you; see what's included in the price.

On top of that, the Cherokee Village improvement district (CVSID) charges a yearly fee per lot, collected with the property tax, that maintains the lakes, roads and common areas. The amount is to be confirmed. Golf is paid separately, only if you use it.

Do I have to declare the land in my home country?

Probably, depending on your country's rules. In Argentina and Brazil a property abroad goes into the yearly asset declaration; in Chile, ask your accountant how to report it to the SII.

What to do before you buy

Ask your accountant how to declare the lot at home, keep your purchase documents and think about who would inherit it: see estate tax and inheritance for US land. Frequently asked questions

Is an ITIN the same as a Social Security number?

No. An SSN is for people allowed to work in the US. An ITIN is for taxes only, used by people who cannot get an SSN.

How much does an ITIN cost?

Applying at an IRS office is free. Acceptance agents and accountants charge their own fees.

Does an ITIN expire?

It can. If it expires and you need to file a return, the IRS says you renew it with the same Form W-7.

Do I need a US bank account to own a lot?

No. You pay the instalments from home, and the seller pays the property tax until the deed.
